Terms of Service

Last updated August 13, 2026

These Terms of Service ("Terms") govern the use of Ekko's software and services ("Ekko," "we," "us") by the church, ministry, or other organization that creates an Ekko account ("Customer," "your organization"). By creating an account, or by confirming agreement during account setup, the person doing so represents that they have the authority to bind their organization to these Terms.

1. Definitions

2. The Service

Ekko is a planning layer for church strategic planning — it helps a church connect its mission and vision to weekly ministry activity. Ekko is not an operating system: it is designed to sit above the tools your organization already uses for scheduling, communication, and operations (for example, a church management system), and to exchange information with them where integrations exist.

3. Accounts & Access

Customer is responsible for its own account, including every Authorized User it invites and every access decision it configures. Organization Administrators may add, remove, and configure the access of Authorized Users at any time. Customer is responsible for keeping its roster current and for promptly removing access for anyone who should no longer have it.

4. Customer Data

Customer Data belongs to Customer. Ekko claims no ownership or intellectual property interest in Customer Data. Ekko processes Customer Data solely to provide the Services, as described in our Privacy Policy.

Customer represents and warrants that it has all rights and permissions necessary, under applicable law and its own policies, to enter any personal information about any individual — including staff, volunteers, and any other Authorized User — into Ekko. This includes, where Customer enables volunteer accounts, a representation that any volunteer added to Ekko who is under 18 meets whatever minimum-age configuration Customer has set for its organization within the Services.

5. Acceptable Use

Ekko may be used only for its intended purpose: organizing and planning the activities of a church, ministry, or comparable nonprofit organization. Customer agrees not to use the Services to store categories of data Ekko is not designed to hold — including Social Security numbers, government identification numbers, or protected health records — and not to use the Services in any way that violates applicable law or infringes the rights of any third party.

6. Subscription, Fees & Billing

Fees, billing terms, and any trial period applicable to Customer's account are set out in Customer's order form or account setup, and are incorporated into these Terms by reference.

7. Assessments & AI Features

Ekko includes personality and spiritual-gifts assessment features, some of which are self-reported by individual users and some of which use Anthropic's Claude API to process uploaded documents or generate planning assistance. Customer configures who within its organization can see the results of these assessments; Ekko does not make that visibility decision independently. Details on how assessment and AI-processed data are handled are in our Privacy Policy and our Individual Data & Assessment Notice.

8. Volunteers

Where Ekko offers volunteer accounts, a volunteer's participation — including completing any assessment and sharing its results with Customer — is the volunteer's own choice, distinct from the disclosure that applies to staff Authorized Users. A volunteer may complete an assessment for their own use without sharing the results with Customer; Customer may still see that a volunteer has an account and whether they have chosen to share, without seeing the results themselves, unless the volunteer has chosen to share them. Customer is responsible for representing an accurate minimum age, per Section 4, for any volunteer account it creates or approves.

9. Termination & Data Export

Customer may terminate its account at any time. Upon termination, Customer Data will be made available for export for a reasonable period, after which it will be deleted in accordance with our data retention practices, described in our Privacy Policy.

10. Warranties & Disclaimers

The Services are provided "as is," without warranty of any kind, express or implied, except as expressly stated in these Terms.

11. Limitation of Liability

[Placeholder — liability cap and excluded-damages language to be finalized with counsel.]

12. Indemnification

Customer agrees to indemnify and hold Ekko harmless from any claim arising out of the conduct of Customer, its Organization Administrators, or its Authorized Users.

13. Governing Law & Dispute Resolution

[Placeholder — governing law, venue, and dispute-resolution mechanism to be finalized with counsel.]

14. Changes to These Terms

We may update these Terms from time to time. Material changes will require your organization's Organization Administrator to accept the updated Terms before continuing to use the Services.
